Step 1: Identification of the relevant data
Before a self-declaration is completed, road authorities, road operators, tolling operators, recharging and refuelling-related stakeholders and holders of in-vehicle generated data, in coordination with the ITS Contact Point, can check whether they collect, share or update data on the infrastructure, on the regulations and restrictions, on the state of the network and on the real-time use of the network. The relevant datasets, sorted in six categories, are listed in detail in the annex to the Delegated Regulation and can be found using the following link.
Step 2: Provide the relevant data through the National Access Point (www.mobilitaetsdaten.gv.at)
If data holders collect or update the above-mentioned type of data, the associated metadata must be recorded on the National Access Point, www.mobilitaetsdaten.gv.at.
Step 3: Fill in the self-declaration form and collect all required Annex information
In the download area, the self-declaration form for all of the above-mentioned actors to declare compliance with Delegated Regulation (EU) 2022/670 can be downloaded. The form must then be completed entirely and truthfully and signed by an authorized signatory. The required annexes are listed on the form and can be put together in a format of your choice or together with the accompanying documents.
Step 4: Submit the filled-in self-declaration, including Annexes
The completed and signed form, including the necessary annexes, can be sent by e-mail in PDF format to kontakt@ivs-stelle.at.

This data must comply with the requirements related to the accessibility, exchange and re-use of the respective data. Tolling operators ensure that the data provided is regularly updated. All stakeholders involved (data holders and data users) work together to report data errors immediately and correct any data inaccuracies identified as soon as possible. Recharging and refuelling-related stakeholders ensure that the data provided is updated regularly. All stakeholders involved (data holders and data users) work together to report data errors immediately and correct any data inaccuracies identified as soon as possible. According to Delegated Regulation (EU) 2022/670, holders of in-vehicle generated data, which act as data holders, are required to provide data on the status of the network or on the real-time use of the network, that they are collecting, sharing or updating, at the National Access Point (www.mobilitaetsdaten.gv.at). This data shall comply with the requirements related to the accessibility, exchange and re-use of the respective data. Owners of data generated in the vehicle must ensure that the data provided is regularly updated. This is the case if the institution uses, processes or displays types of data on infrastructure, regulations and restrictions, on the state of the network or on the real-time use of the network, to provide a real-time traffic information service/other products/services or if the institution updates relevant data during its activities. The institution is not obliged to provide a declaration only if it acts as a mere transmitter of information.
Step 2: Filling out of the declaration form and compile all the annexes
The form for actors acting as data users to declare compliance with Delegated Regulation (EU) 2022/670 can be downloaded in the download area. The form must then be filled out completely and truthfully and signed by an authorized person. The required attachments are listed in the form and can be compiled in a freely selectable format or as well as with the accompanying documents.
Step 3: Transmission of the declaration including enclosures
The completed and signed form, including the necessary enclosures, can be sent by e-mail in PDF format to kontakt@ivs-stelle.at.
Road authorities and road operators, when acting as data users, are obliged under Delegated Regulation (EU) 2022/670 to keep the types of data on infrastructure, regulations and restrictions and on the state of the network that they use, process or display up to date in coordination with the data holders and to report inaccuracies immediately to the data holders. According to Delegated Regulation (EU) 2022/670, digital map producers, as data users, are required to update types of data on the infrastructure and on regulations and restrictions they use, process and display in constant cooperation with data holders and to include the data in question in their existing map and map update services in a timely manner. Towards meeting public policy objectives, such as road safety, digital map producers should cooperate with national authorities to correct inaccuracies in their data in a timely manner. According to Delegated Regulation (EU) 2022/670, tolling operators, when acting as data users, are obliged to keep the types of data on the infrastructure and on the regulations and restrictions that they use, process or display up to date in coordination with the data holders and to report inaccuracies immediately to the data holder. This is the case if the company uses, processes or displays types of data on the infrastructure, on the regulations and restrictions, on the state of the network and on the real-time use of the network as a data user in order to offer a real-time traffic information service or another product/service or updates relevant data in the course of its activities. A company is only exempt from declaration if it acts as a mere transmitter of information. If the service provider, as a data holder, records or updates the above-mentioned data, the associated metadata must be recorded on the National Access Point, www.mobilitaetsdaten.gv.at.

This data must meet the requirements regarding the accessibility, exchange and further use of the respective data. Service providers ensure that the data provided is regularly updated. If service providers act as data users, they are obliged, according to Delegated Regulation (EU) 2022/670, to keep the above-mentioned types of data that they use, process or display up to date in coordination with the data holders and to report inaccuracies immediately to the data holders. The declaration refers to Article 12 ‘Assessment of compliance’ of the Delegated Regulation:
Data Holders and Data Users declare to comply with the requirements of Articles 3 to 11 of Delegated Regulation (EU) 2022/670. The following documents are required for the compliance check by the ITS Contact Point:
- a description of the data, digital map or real-time traffic information services they provide as well as the information on the quality thereof and the conditions of re-use of these data;
- an evidence-based declaration of compliance with the requirements set out in Articles 3 to 11.
The ITS Contact Point randomly checks the correctness of the submitted declarations and their annexes.
According to the annex to Delegated Regulation (EU) 2022/670, the following data are relevant:
1. The types of data on infrastructure:
a) road network links and their physical attributes:
i) geometry;
ii) road width;
iii) number of lanes;
iv) gradients;
v) junctions;
b) road classification;
c) location of tolling stations;
d) location of service areas and rest areas;
e) location of recharging points for electric vehicles and the conditions for their use;
f) location of compressed natural gas, liquefied natural gas, liquefied petroleum gas stations;
g) location of refuelling points and stations for all other fuel types;
h) location of delivery areas.
2. The crucial types of data on regulations and restrictions:
a) static and dynamic traffic regulations, where applicable:
i) access conditions for tunnels;
ii) access conditions for bridges;
iii) permanent access restrictions;
iv) speed limits;
v) freight delivery regulations;
vi) overtaking bans on heavy goods vehicles;
vii) weight/length/width/height restrictions;
viii) one-way streets;
ix) boundaries of restrictions, prohibitions or obligations with zonal validity, current access status and conditions for circulation in regulated traffic zones;
x) direction of travel on reversible lanes;
b) traffic circulation plans.
c) static and dynamic traffic regulations, where applicable:
i) access conditions for tunnels;
ii) access conditions for bridges;
iii) permanent access restrictions;
iv) speed limits;
v) freight delivery regulations;
vi) overtaking bans on heavy goods vehicles;

a) the location and identification of traffic signs reflecting traffic regulations and identifying dangers:
i) access conditions for tunnels;
ii) access conditions for bridges;
iii) permanent access restrictions;
iv) other traffic signs reflecting traffic regulations;
b) static and dynamic traffic regulations, where applicable, other than traffic regulations referred to in point (2);
c) identification of tolled roads, applicable fixed user charges and available payment methods (including retail channels and fulfilment methods);
d) variable road user charges and available payment methods, including retail channels and fulfilment methods
4. The crucial types of data on the state of the network:
a) road closures;
b) lane closures;
c) roadworks;
d) temporary traffic management measures.
5. Other types of data on the state of the network:
a) bridge closures;
b) accidents and incidents;
c) poor road conditions;
d) weather conditions affecting road surface and visibility.
6. The types of data on the real-time use of the network:
a) traffic volume;
b) traffic speed;
c) location and length of traffic queues;
d) travel times;
e) waiting time at border crossings;
f) availability of delivery areas;
g) availability of recharging points and stations for electric vehicles;
h) availability of refuelling points and stations for alternative fuel types;
i) price of ad hoc recharging/refuelling.
